Operations of Departure Order System

  The Act Amending Part of the Immigration Control and Refugee Recognition Actwas enforced since December 2.2004,established "Departure Order System." (For more information on the System, see Note 1) As a result, a lot of foreign residents who stay in Japan beyond the authorized period of stay will voluntary appeared at regional immigration bureaus and other immigration offices to apply for the new system. If a foreign resident who stays in Japan beyond the authorized period of stay will voluntary appeared at a regional immigration bureau by December 1 and falls under the requirements as stated in the 1 below, the Departure Order System will be applicable. If you would like to go back to your home nation at an early date, we recommend you to appear your nearest regional immigration bureau as soon as possible.
  In principle, an foreign resident who has been deported from Japan may not enter Japan for five or ten years (note #2) after being deported. On the other hand, if a foreign resident leaves Japan due to a departure order, the alien may not enter Japan for a year after leaving Japan.

(Note 1) Under the departure order system, the immigration bureau may order an foreign resident who stays in Japan beyond the authorized period of stay to leave Japan after simple procedures without physical restraint if the foreign resident who stays in Japan beyond the authorized period of stay satisfies certain requirements.
(Note 2) If a foreign resident is deported from Japan due to his/her illegal stay and falls under the requirements [4.1.] stated below, the foreign resident may not enter Japan for 10 years. If aforeign resident who stays in Japan beyond the authorized period of stay falls under any of the other requirements stated below, the foreign resident who stays in Japan beyond the authorized period of stay may not enter Japan for five years.

 

1.    The Departure Order System is applicable if...
   A foreign resident who stays in Japan beyond the authorized period of stay will voluntary appeared at a regional immigration bureau and comes under all of the followingrequirements:
  1. The foreign resident wishes to go back to his/her home nation at an early date (generally in December);
  2. The foreign resident does not come under any of the grounds for deportation other than illegal stay;
  3. The foreign resident has never been sentenced to imprisonment with or without labor ona charge of larceny or other prescribed crimes after entering Japan;
  4. The foreign resident has no past record of deportation, nor that of departure under a departure order;
  5. The foreign resident is able to prepare his/her airline ticket for returning home.

2.   Where to visit
   This System requires certain procedures at the regional immigration bureaus listed below. The immigration bureau's website (http://www.immi-moj.go.jp/English/soshiki/index.html) provides location maps of these regional immigration bureaus.

4.   Reference information :Outline of the amended Immigration Control Act enforced since December 2, 2004
   In addition to establishing the Departure Order System, the Immigration Control Act amended as follows:
  1. The period of denial of landing has been extended to 10 years after being deported for a so-called 'repeater' (cases where a foreign national had a past record of being deported or ordered departure and has deported again) since December 2,2004.
  2. The upper limit for the amount of fines for illegal entry or illegal stay has been raised to 3 million yen, 10 times as much as, and upper limit for the amount of fines for encouragement of illegal employment has been raised to 3 million yen.
  3. The Status of Residence Revocation System was established for cases where a foreign national who have obtained permission for landing etc. by making a false statement or other dishonest means, or other cases.
